Democrats in search of purpose and function

This morning' s news is about Democrats attempting to identify a leader or leaders to guide them in reshaping the party's purpose and to restoring functional performance. Those are my words, not theirs.

Both American political parties are broken and off-track. The loser party is more aware than the winner. The most visible symptom of the Democratic Party's problem is from its having failed to counter Donald Trump's assault on democracy as he has become the incumbent.

President Trump is allegedly in violation of the Emolument Clause of the U.S. Constitution. With his family members, they have conflicts of interest that may include those with Russian entities.

The President's penchant for constant lying is a violation of the federal law making it a crime for officials to lie. The Misprision of fraud law was violated by how the President mishandled the Michael Flynn problem.

The federal offense of failure to disclose a felony, if coupled with some act concealing the felony, such as suppression of evidence, harboring or protecting the person performing the felony, intimidation or harming a witness, or any other act designed to conceal from authorities the fact that a crime has been committed. 
Title 18 U.S.C. § 4. Misprision of felony. Whoever, having knowledge of the actual commission of a felony cognizable by a court of the United States, conceals and does not as soon as possible make known the same to some judge or another person in civil or military authority under the United States, shall be fined under this title or imprisoned not more than three years, or both. 
A federal judge, or any other government official, is required as part of the judge’s mandatory administrative duties, to receive any offer of information of a federal crime. If that judge blocks such report, that block is a felony under related obstruction of justice statutes and constitutes a serious offense. 
Upon receiving such information, the judge is then required to make it known to a government law enforcement body that is not themselves involved in the federal crime."

President Trump issued an illegal Executive Order to ban immigration that he publically characterized as a ban against Muslims. That was a clear violation of the U.S. Constitution. While the court struck down his incompetently written order, his sentiment continues in The White House.

The President's legitimacy remains in question shrouded by the evidence that Russians mounted a propaganda campaign against Hilliary Clinton that Trump publically championed. That was an act of collusion if argued competently in court.

So, where are the Democratic Party lawyers?

The U.S. Congress and Executive Branch are in lock step in supporting and defending Trump. It is clear that leaders in both GOP-controlled chambers have obstructed justice and have sought to interfere in investigations of Trump's possible violations of the law.

An unprecedented argument can be made that the sitting government is wholly illegitimate including the Executive Branch and Majority Party in Congress on the merit of their unAmerican behavior.

This analyst concludes that the first purpose of the Democratic Party is to restore Democracy to America. To accomplish that requires a competent organization. It is a long way to go to make the Democratic Party competent again. The clock it ticking.

Atlanta (CNN) For all the marches and protests the left has generated since Election Day, the debate over who will lead the Democratic Party in the early stages of Donald Trump's presidency is underscoring the divisions still lingering within its ranks. 
Eight candidates to become the next Democratic National Committee chair -- led by former Labor Secretary Tom Perez and Minnesota Rep. Keith Ellison -- struggled during a debate sponsored by CNN Wednesday to define a vision of how they would effectively counter Trump's administration and break through in clear opposition to his message.
Perez and Ellison recently spotted dining together, said they didn't cut any deals ahead of the 447 DNC members' vote for chair Saturday in Atlanta and pledged to confront Trump with a unified party. But the debate showed the party hadn't settled questions over just how vigorously to oppose Trump, or how to settle division within its ranks. 
Ellison said Trump's actions so far "legitimately raise the question of impeachment." He said Trump has already violated the Constitution and called for an investigation to "make sure that nobody can monetize the presidency and make a profit off it for our gain."
"We have seen from the get-go that this person wants to turn the clock back, and the Democratic Party needs to take the fight to Donald Trump," Perez said. "When we lead with our values, when we lead with our conviction, that's how we succeed."
