Presidential Failure

·    The 25th Amendment to the U.S. Constitution addresses presidential succession and disability. Ratified in 1967 after the 1963 assassination of President John F. Kennedy, it clarifies what happens if the president dies, resigns, is removed, or becomes unable to perform their duties. 

In the event of President Trump’s inability to perform his duties, Vice President Vance is his successor with the caveat that Vance can perform his oath of office and is not also corrupted. 

What makes President Trump unable to perform his duties? The process by which to make this determination is impeachment, in the absence of debilitating medical conditions or death.

Herein lies a complication because one of the possible charges against President Trump is his attack on the US Constitution and the rule of law. It includes Trump’s series of court-determined illegal actions as well as his overt attack on American cities and citizens, including the misuse of the American military. Those things are evident to the public, and a tally of them will be part of the impeachment document as evidence.

A barrier to justice is the Republican Congress in the House and Senate, which is complicit in collaborating with the President in undermining their oaths and allegiance to preserve and protect our American freedoms. This means that the legal process and rule of law are corrupted, and actions are necessary to bypass the corruption. In fact, many, if not all, of the Republican officials will be named in the suit.  

The US Supreme Court would have to make determinations to support the litigation, except that some members of the court were appointed by Trump, and they, too, are complicit. 

Congressional Correction

Until the voters change Congressional political representation and leadership, there is no path forward to impeaching and prosecuting those who have committed egregious crimes against our nation. 

If the citizens chose Democratic representation in the House and Senate, then impeachment and prosecution can go forward.

This will be complicated by the Vice President seeking to retain the position of President. More action will be required to make the case that J. D. Vance is also unfit.

If there is resistance, the obstruction might rise to the point of military intervention, which would be a coup.

The scenario and way forward are incredibly chaotic and unstable. Needed is patriotic motivation to strike a chord among Republicans.
